New Delhi: The Supreme Court on Friday issued notice to Bollywood actress Karisma Kapoor on an application filed by Priya Kapur, seeking certified copies of records related to the 2016 divorce proceedings between Karisma Kapoor and industrialist Sunjay Kapur. During an in-chamber hearing, a single-judge Bench of Justice A.S. Chandurkar directed Karisma Kapoor to file her response within two weeks.
Priya Kapur Seeks Divorce Case Documents
Priya Kapur has approached the apex court requesting certified copies of all documents connected with the divorce case, including the divorce petition, pleadings, court orders and, most importantly, the settlement recorded between Karisma Kapoor and Sunjay Kapur in 2016. She stated that access to these records is necessary for the adjudication of an estate dispute currently pending before the Delhi High Court.
Settlement Terms Central to Estate Dispute
In her application, Priya Kapur argued that the financial arrangements and custody terms agreed upon during the divorce are crucial for resolving issues in the ongoing litigation. According to her counsel, questions regarding children’s financial arrangements, education expenses and post-divorce obligations have repeatedly surfaced in the estate case, making it essential to place the full background of the settlement on record.
Dispute Over Will and Property
The application is linked to a broader family dispute over Sunjay Kapur’s estate. His children from his marriage with Karisma Kapoor have sought a share, alleging that a will favouring his widow, Priya Sachdev Kapur, was tampered with. It was argued that examining the divorce settlement would help determine whether the claims now being raised had already been settled during Sunjay Kapur’s lifetime.
Background of the Case
Sunjay Kapur married Karisma Kapoor in 2003 and the couple divorced in 2016 after reaching a settlement on custody and financial matters. Kapur passed away at the age of 53 following a heart attack while playing polo in the UK. He is reported to have left behind property worth approximately ₹30,000 crore.
