    Shilpa Shetty & Raj Kundra Move Bombay HC to Quash Rs 60-Crore Cheating Case

    Mumbai: Bollywood actor Shilpa Shetty and her businessman husband Raj Kundra have approached the Bombay High Court seeking to quash a Rs 60-crore cheating case filed against them by the Economic Offences Wing (EOW) of Mumbai Police.

    The couple has also requested the court to restrain the police from filing a chargesheet or taking coercive action until their petitions are finally decided.

    Hearing Scheduled for November 20

    The petitions were listed for hearing on Monday before a division bench comprising Chief Justice Shree Chandrashekar and Justice Gautam Ankhad. After preliminary submissions, the court directed the petitioners to serve copies of their pleas to the complainant, Deepak Kothari, and adjourned the matter to November 20.

    Allegations Against the Couple

    Deepak Kothari alleged that between 2015 and 2023, Shilpa Shetty and Raj Kundra induced him to invest Rs 60 crore in their company, Best Deal TV Pvt Ltd, promising lucrative returns. The complaint claimed that the invested funds were diverted for personal use instead of company operations.

    Couple Contends FIR Is Malicious

    In their quashing petitions, the couple stated that the FIR is based on a “false and distorted set of facts” and was maliciously filed to extort money.

    Shilpa Shetty, in her separate plea, emphasised that she was not involved in the day-to-day affairs of the company and had a limited association with it.

    Business Losses, Not Fraud

    The couple argued that the dispute is purely civil and contractual, stemming from a failed business venture. They cited unforeseen economic circumstances, including demonetisation in November 2016, which impacted cash-based operations.

    The petitions claim that the losses were ordinary business losses, not the result of any fraudulent design or criminal conspiracy.
