Twisha Sharma suicide case: Former judicial officer Giribala Singh denies allegations, High Court reserves decision

Bhopal: The Madhya Pradesh High Court on Monday heard the bail plea of former judicial officer Giribala Singh in the case related to the death of Twisha Sharma. During the hearing, Giribala Singh denied the allegations of cruelty towards her daughter-in-law, Twisha Sharma, and abetment to suicide. Her lawyer argued that her displeasure with Twisha’s decision to have an abortion cannot be considered harassment.

After hearing arguments from both parties in the court of Justice Ajay Kumar Nirankari, the High Court reserved its decision on the bail plea.

Displeasure with the decision to have an abortion cannot be considered harassment: Defense

Giribala Singh’s senior lawyer argued in court that she was displeased with Twisha’s decision to have an abortion because her son and Twisha’s husband, Samarth Singh, also wanted a child. However, the defense claimed that Giribala Singh neither pressured Twisha to have an abortion nor subjected her to cruelty.

According to the lawyer, the mother-in-law was upset that her daughter-in-law disobeyed her and had an abortion. He stated that this reaction was made in anger, and Giribala Singh later apologized for her remarks.

Referring to the alleged chats that surfaced in the case, the defense stated that the words allegedly calling Twisha a “murderer” regarding the abortion were said in anger. The lawyer argued that these messages did not prove that Giribala Singh instigated Twisha to commit suicide.

The defense also claimed that the chats presented in the case pointed to Samarth Singh’s alleged behavior, not her mother’s. The lawyer stated that Twisha was not confined to her in-laws’ home and had even applied for a job in Delhi, where she was planning to move.

The defense sought bail, citing the nature of the alleged crimes and the applicable legal provisions.

Prosecution expresses fear of influencing witnesses and evidence

Opposing the bail plea, senior advocate Siddharth Agarwal, representing the prosecution, argued that Giribala Singh could influence witnesses and evidence while the investigation is ongoing.

After hearing arguments from both sides, the High Court reserved its decision on the bail plea.

Twisha was found dead at her in-laws’ house five months after marriage

This case concerns the death of Twisha Sharma, a resident of Noida. Twisha met Bhopal lawyer Samarth Singh through a dating app, after which the two married. Samarth Singh is the son of former judicial officer Giribala Singh.

On May 12, Twisha was found hanging at her in-laws’ house in Bhopal. Following the incident, which occurred nearly five months after their marriage, her family had accused her husband and in-laws of domestic violence and harassment for dowry.

An FIR was registered at the Katara Hills police station in Bhopal under relevant sections of the Indian Penal Code (IPC) and the Dowry Prohibition Act.

Previously granted anticipatory bail was revoked by the High Court

Giribala Singh is a former chairperson of the District Consumer Disputes Redressal Commission in Madhya Pradesh. She was initially granted anticipatory bail in this case by the Sessions Court.

However, after the state government and Twisha’s family challenged that order, the High Court revoked the anticipatory bail. The High Court is now awaiting a decision on her new bail plea.
