Patna: A man from Muzaffarpur, Bihar, named Janak Kishore Jha, has filed a notice seeking Rs 50 lakh in compensation from Indian Railways, citing negligence. Jha and his in-laws were unable to board the Swatantrata Senani Express on January 26, despite having AC-3 tickets, because the door to their coach was locked from the inside.

Jha claims that after multiple attempts to get assistance from railway staff, no help was provided, resulting in the train leaving without them. He has formally requested a refund of his ticket fare with interest from the Chairman and CEO of the Indian Railway Board within 15 days. He has also threatened legal action and is demanding Rs 50 lakh in compensation if the refund is not processed in that time frame.

According to Jha, missing the train meant he and his family could not attend the Maha Kumbh, a significant religious event that occurs once every 144 years. He argues that this loss has caused both financial and emotional distress.

Jha explained, “I had booked AC-3 tickets from Muzaffarpur to Prayagraj for myself and my in-laws. When the train arrived, the door to our coach was locked. Despite our efforts to get help from the station master and the Government Railway Police, no one assisted us, and the train departed. This is a clear case of negligence, and we are demanding a refund with interest.”

His lawyer, S.K. Jha, has framed the case under the Consumer Protection Act, asserting that the Railways is responsible for ensuring passengers can board their designated trains safely and reach their destinations on time. The failure to do so has caused the complainant financial, mental, and physical distress. The advocate stated that if the authorities do not comply with the refund request, they will pursue legal action.
