High Court bans any new construction in Kharar; seeks response from Punjab government by 27th, know the full matter

The Punjab-Haryana High Court has given a jolt to the Punjab Government and banned any new construction work in Kharar. The High Court has issued this stay order on construction work till May 27 due to the lack of a master plan. According to the information, the High Court passed this interim stay order in the case of 'Omega Infra Estate Private Limited vs. Rahul Tiwari and others' after a delay of 14 years in finalizing the master plan of Kharar, in which serious concerns were expressed over haphazard construction in the absence of a master plan of Kharar.

According to the information, the High Court passed this interim stay order in the case of ‘Omega Infra Estate Private Limited vs. Rahul Tiwari and others’ after a delay of 14 years in finalizing the master plan of Kharar, in which serious concerns were expressed over haphazard construction in the absence of a master plan of Kharar.

Master plan was made in 2010, but no action was taken

The old master plan was made in 2010, the period of which expired in 2020, after this a new master plan was made in 2020, but even after five years of making the master plan, it has not been notified till date.

Ban on new construction work till May 27

Taking a strict stand in this matter, the High Court said that due to the absence of a master plan, construction work is being done in a haphazard and unorganized manner in the entire Kharar. The High Court has banned any new construction in Kharar till May 27 and has now sought a response from the Punjab government in this regard.

Response sought from the Punjab government

Let us tell you that due to the absence of a master plan, whoever wants to do construction work is being allowed to do so, but a condition is being imposed that this construction work should be correct under the new master plan. Against this, a builder company had filed a petition in the High Court seeking the implementation of the new master plan at the earliest.

Disposing of this petition last year, the High Court had ordered the government to take action on it within eight weeks. But despite the orders of the High Court, the new master plan was not notified, against which a contempt petition has been filed in the High Court, on which the Punjab Government has not given any concrete information so far, now the High Court has taken a tough stand and has stayed the permission for any new construction in Kharar till further orders.
